Terms and Conditions

By using the www.fishwell.co.uk website, you enter into a contract with us Fishwell, which includes conditions limiting our liability and relating to our use of your personal information. This contract is just for the use of our web site and separate to any arrangement you may have with any other organisation for providing internet services.

Definitions

'consumer' - You are a consumer you could be an individual, business, trade or profession.

'account' - An account is created when you sign up as a customer of our website.

'personal data' - Any information about an identifiable living person (for example, your name, address or phone number).

'we', 'us', 'our' Fishwell LTD

'you', 'your' - The person who is entering into this contract with us and who the account will be registered for.

Deliveries


We endeavour to dispatch your order within 5 working days. There are, however, some circumstances in which products are not available (see note on availability below), in which case you will be contacted as soon as possible to make alternative arrangements. Depending on the nature of the delay, it may be possible to dispatch part of your order, with the remainder being delivered at the next opportunity. Where the delay is longer than one week, we will fully refund your delivery charge. In all other circumstances you will be emailed with a delivery date and approximate time shortly after you have ordered.

Next day delivery: If you require next day delivery please telephone us to discuss availability and cost.  We will accomodate this where we can.

Receiving your goods: Please ensure that you check through your delivery whilst the driver is still present, and before you sign the delivery note. This will enable claims to be made in the event of any damage/loss. Should you find that any goods are damaged or not present, please highlight this on the drivers paperwork and sign for the rest of the goods and telephone us to inform us of the problem (please see contacts page for details). The outstanding items will be dispatched as soon as possible, and at no extra charge.

If the goods are not checked, are not signed for or the drivers paperwork is signed "unchecked" Fishwell Ltd will not be able to claim back from the carrier therefore we will not be able to credit for the damaged goods.  Any replacements needed will be chargeable along with the cost of delivering them.  

Availability

Whilst every effort is made to keep all items on this site in stock, there are occasions when we cannot source certain products. If we can not fulfil your order, we will notify you immediately and (where possible) arrange an alternative. Where an alternative is not possible, you have the option to either Back Order the goods, or cancel these items and we will refund the cost.

Back Order: Outstanding goods will be delivered when they become available, with no additional cost. You will be contacted to arrange a convenient delivery time.

Storage

Lengths of UPVC materials should be stored flat and out of direct sunlight. Lengths of Polyboard internal window cill should also be kept dry. All lengths over 5 metres should be supported at both ends when carrying. Silicones should be kept at above 5ºc and below 28ºc, and protected from frost. In all instances the manufacturer’s instructions should be followed. See our “Products” section for links to the manufacturer’s web sites.

We are an independent stockist, and from time to time we source goods from different manufacturers to those listed. Pictures are, therefore, for illustrative purposes only and we reserve the right to alter products without notice. Wherever there is a significant difference in the product’s ability to fulfil its purpose, we will endeavour to inform you prior to delivery. These circumstances are rare, and in most cases you will receive the goods detailed.


Returns

All returns due to customer error are subject to a 25% restocking charge.  
Any goods that are returned to Fishwell due to errors in ordering are to be returned at the customers risk.  It is the customers responsibility to send back the goods if at all possible.  Fishwell can try to arrange a carriage forward via out carriers but the fee will be chargeable to the customer.  Any items broken in transit upon returning to Fishwell Ltd will be chargable. Refunds will only be issued once goods have arrived successfully at Fishwell Ltd.  

Payment

Fishwell Ltd accept all major credit cards but if placing an order by telephone or at our trade counter please be aware that an extra 2% charge will apply to American Express cards.

Personal data

We will not make your personal data available to any third parties.  For more information please see our privacy policy.

Cancelling or altering an account.

We may cancel your account or put it on hold if :

" You have broken any part of our agreement
" We receive sufficient proof that your account is being used fraudulently.

We may (but do not have to) cancel, alter or amend your account at any time.

This Contract

The internet is constantly changing and developing. As a result of this, we reserve the right to make reasonable changes to the terms of this contract at any time during the term of the contract. We will only do so when we have good reason. Unless we are acting because of a legal requirement or a court order, the change will only be made after we have consulted publicly. We will publish a notice in advance (ideally, 30 days in advance) on our website and provide a link from the main page. The changes will apply from the date shown in the notice. You should visit our website regularly to find out about any changes. If you do not agree with any change to the conditions, you may notify us that you want to end the contract in at least 30 days' time. 

This contract is a legally binding document. You should read it carefully and make sure that it contains everything you want and nothing you are not prepared to agree to.
